RIGHT OF WITHDRAWAL FROM THE CONTRACT

Cancellation Policy

  1. Any consumer who has concluded a distance sales contract with NIK Tech Bulgaria Incorporated in Bulgaria (i.e., via the NIK Tech Bulgaria website, email, fax, or telephone) has the right to withdraw from this contract within 14 days without giving any reason.
  2. The withdrawal period expires 14 days after the day: a) on which the customer or a third party, other than the carrier and indicated by the customer, has taken possession of the goods; b) on which, in the case of a contract for the transfer of ownership of multiple goods delivered separately, the customer or a third party, other than the carrier and indicated by the customer, has taken possession of the last delivered good.
  3. To exercise the right of withdrawal, the consumer must inform NIK of their decision to withdraw from the contract by an unequivocal written statement (e.g., a letter sent by post; fax, or email) sent to the following address: Warehouse of NIK Tech Bulgaria Incorporated in Bulgaria, Shiraz Cl, Glen Marais, Kempton Park, 1619, South Africa.   4. The customer may use the withdrawal form available on the NIK website. Using this form is mandatory since we need a heads-up about the intended return. A return without prior notification will not be accepted by the warehouse team.
  5. To meet the withdrawal deadline, it is sufficient for the consumer to send their communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

  1. If the consumer withdraws from the contract, NIK will refund all payments received from the consumer, including the costs of delivery (except for additional costs resulting from the consumer's choice of a delivery method other than the standard delivery offered by NIK), within 14 days from the day on which NIK is informed of the consumer's decision to withdraw from the contract. NIK will carry out the refund using the same means of payment as the consumer used for the initial transaction, unless the consumer has expressly agreed otherwise; in any event, the consumer will not incur any fees as a result of the refund. NIK may withhold the refund until it has received the goods back and confirmed they have not been used.
  2. The consumer should send back or hand over the goods to Warehouse of NIK Tech Bulgaria Incorporated in Bulgaria, Shiraz Cl, Glen Marais, Kempton Park, 1619, South Africa, without undue delay and in any event not later than 14 days from the day on which the consumer informs NIK of their decision to withdraw from the contract.
  3. The deadline is met if the consumer sends back the goods before the 14-day period has expired.
  4. The consumer will bear the direct cost of returning the goods.
  5. The consumer is only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Exclusions from the Right of Withdrawal and Circumstances in Which the Consumer Loses the Right of Withdrawal

  1. The consumer does not have the right to withdraw from the following distance contracts: a) for the provision of services if the seller has fully performed the service with the consumer's prior express consent, and the consumer has acknowledged that they will lose their right of withdrawal once the service has been fully performed by the seller; b) for the supply of goods or services for which the price depends on fluctuations in the financial market that cannot be controlled by the seller and which may occur within the withdrawal period; c) for the supply of non-prefabricated goods made on the basis of an individual choice or decision by the consumer or goods made to the consumer's specifications; d) for the supply of goods which are liable to deteriorate or expire rapidly; e) for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery; f) for the supply of goods which are, after delivery, according to their nature, inseparably mixed with other items; g) where the consumer has specifically requested a visit from the trader to carry out urgent repairs or maintenance; if, during such a visit, the trader provides services in addition to those specifically requested by the consumer or supplies goods other than replacement parts necessarily used in performing the maintenance or repairs, the right of withdrawal applies to those additional services or goods; h) for the supply of sealed audio or sealed video recordings or sealed computer software which were unsealed after delivery; or for the supply of newspapers, periodicals or magazines with the exception of subscription contracts for the supply of such publications; i) for contracts concluded at a public auction; j) for the supply of digital content which is not supplied on a tangible medium if the performance has begun with the consumer's prior express consent and their acknowledgment that they thereby lose their right of withdrawal.
